1) Who we are

Shark Ads Marketing Limited (“Shark Ads Marketing”, “we”, “us”, “our”) is a Trinidad & Tobago–based marketing and technology company that provides digital marketing, analytics, advertising, and related services. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our websites, interact with our content, or use our services.

2) Scope

This Policy covers:

  • Our websites and landing pages that we operate.

  • We owned social media pages.

  • Campaign pages, forms, and microsites we run for ourselves or on behalf of clients.

  • Communications with us (email, chat, phone, WhatsApp, forms).

  • SaaS, analytics, and ad-tech tools we use to deliver services.

Where we process personal information on behalf of our clients (e.g., for ad campaigns, CRM/email automation), we act as a processor and our client is the controller. See “Controller/Processor Roles” below.

  • Personal information: Data that identifies or can reasonably identify a person.

  • Processing: Any operation performed on personal information (collect, use, store, share, etc.).

  • Cookies/Tags/Pixels: Technologies that store or access information on a device, often for analytics or advertising.

A. You provide directly

  • Contact details: name, email, phone, company, role.

  • Form responses: project info, budgets, goals, timelines.

  • Support/content submissions: files, screenshots, testimonials.

  • Preferences and consents: marketing preferences, cookie choices.

B. Automatically collected

  • Device & usage: IP address, device type, OS/browser, pages viewed, time on page, clickstream, referring URLs.

  • Cookies & similar tech: session tokens, analytics identifiers, ad IDs, attribution data (UTMs), approximate location (derived from IP).

  • Email engagement: opens, clicks, bounces (for our email/CRM programs).

C. From third parties

  • Ad/analytics partners (e.g., Google, Meta, TikTok, LinkedIn) for performance, audience, and conversion insights.

  • Data you make public (e.g., social media posts or reviews).

  • Vendors we use to enrich or verify business contact details, where permitted.

5) How we use information (purposes & typical legal bases)
  • Provide and improve services: run campaigns, measure performance, optimise spend (legitimate interests/contract).

  • Respond to inquiries & support (contract / legitimate interests).

  • Personalise experiences & content (consent / legitimate interests).

  • Analytics & research: site performance, funnel analysis, forecasting (legitimate interests).

  • Marketing & remarketing: newsletters, offers, ads based on your interactions (consent where required / legitimate interests).

  • Security & fraud prevention (legitimate interests / legal obligation).

  • Compliance: record-keeping, exercising legal rights (legal obligation / legitimate interests).

6) Cookies & similar technologies

We use:

  • Strictly necessary (required for core site functions).

  • Performance/analytics (understand usage to improve).

  • Functional (remember choices).

  • Advertising (reach you with relevant ads, frequency capping, attribution).

You can manage preferences anytime via the “Cookie Settings” link on our site and through your browser settings. Rejecting some cookies may impact site features.

7) Analytics, ads, and social pixels

We may use tools like Google Analytics/Tag Manager, Meta Pixel, LinkedIn Insight Tag, TikTok Pixel, and similar to measure performance and build audiences. These providers may set their own cookies and receive information about your device, pages viewed, and conversions to help us optimize campaigns. You can opt out or adjust preferences via our Cookie Settings and the platforms’ ad settings.

8) When we share information

We share personal information only as needed:

  • Vendors/Processors: hosting, email/CRM platforms, analytics, ad-tech, payment processing, customer support tools, and security services under contract.

  • Clients: campaign performance and leads generated for that client.

  • Legal: to comply with law, enforce agreements, or protect rights, safety, and security.

  • Business transfers: as part of a merger, acquisition, or reorganisation (with protections).

 

We do not sell your personal information.

9) International transfers

Vendors and servers may be located outside Trinidad & Tobago. Where required, we use safeguards such as contractual commitments to protect personal information during cross-border transfers.

10) Data retention

We retain personal information only as long as needed for the purposes above, to comply with legal obligations, resolve disputes, and enforce agreements. Typical retention ranges from 12–36 months for analytics/ads data and for the duration of a client engagement plus a reasonable period for records.

11) Your privacy rights

Depending on your location and applicable law, you may have rights to:

  • Access, correct, or delete personal information.

  • Object to or restrict processing (including direct marketing).

  • Withdraw consent (where processing is based on consent).

  • Port your data.

  • Lodge a complaint with a supervisory authority.

12) Children’s privacy

Our services are not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child provided personal information, contact us and we will delete it.

13) Security

We use organisational, technical, and physical safeguards appropriate to the nature of the data (access controls, encryption in transit, least-privilege access, logging, vendor due diligence). No method is 100% secure; if we become aware of a breach affecting your data, we will take steps consistent with applicable law.

14) Third-party links

Our sites may link to third-party websites or services. Their privacy practices are governed by their own policies.

15) Changes to this Policy

We may update this Policy from time to time. The “Last updated” date will reflect the latest changes. Significant changes will be highlighted on this page; in some cases we may notify you by email or banner.

16) Controller/Processor roles (for client work)
  • For our own websites and marketing, Shark Ads Marketing is the controller.

  • When we process personal information on behalf of a client (e.g., managing campaigns, handling form leads, running email/CRM), we are a processor and process data under the client’s instructions and our services agreement/data processing addendum (DPA).

If you submitted information through a page we host for a client, please direct rights requests to that client (the controller). We’ll assist the client as required.
